The Democrats have been leaking documents on Judge Brett Kavanaugh left and right, but Senator Thom Tillis (R-N.C.) has a proposition for the senators who found it necessary to leak documents.
Since Kavanaugh's confirmation hearing started, some Democrats have been trying to derail it. When massive protests and personal interruptions didn't work, some senators started to leak confidential emails.
Sen. Cory Booker (D-N.J.) fully admitted that he leaked emails about Kavanaugh's views on racial profiling and affirmative action. Other senators have yet to come forward, but emails about Roe v. Wade have leaked too.
Tillis warned his colleagues that they may “rue the day” they decided to play politics with confidential emails.
I hope everyone will record a transcript of what's going on right now. Senator [Mike] Lee [R-Utah] explains things in eloquent legal terms but let's talk about the consequences of making this an untrusted body to receive documents under the Presidential Records Act. You may rue the day that you do that because you'll probably get fewer documents in the future.”
Tillis responded to claims that the leaks were for the sake of transparency by listing an ultimatum to his fellow senators:
“I would like to suggest for the purpose of the SCOTUS nomination that our all of us waive any right to the speech and debate clause and that we allow all of our email records related to this SCOTUS nomination to be made public on an immediate basis. I for one am ready to sign up for it now and I hope my other members would do the same thing because, in the interest of transparency, certainly, it would make sense for every one of us, regardless of what we want to do in the future to expose that information to the American people.”
The senator added the final jab about “future” plans after an exchange earlier in the day between Booker and Sen. John Cornyn (R-Texas). Cornyn accused Booker of breaching confidentiality for publicity, saying, “Running for president is no excuse for violating the rules of the Senate or of the confidentiality of the documents that we are privy to.”
Purposefully leaking confidential documents is grounds for expulsion from the Senate. It is not yet clear if Booker or any of the other members will face backlash for their actions.
Although Tillis was ready to release his emails relating to Judge Kavanaugh, it doesn't look like his Senate colleagues will be taking him up on that offer.
